These Terms & Conditions (“Terms”) govern your use of websites, landing pages, funnels, digital resources, and other online properties operated by Divine Destinations INC (“Divine Destinations,” “we,” “us,” or “our”).

By accessing or using our websites, submitting information through our online properties, or purchasing products or services where these Terms are presented, you agree to these Terms.

EDUCATIONAL AND BUSINESS INFORMATION

Divine Destinations provides education, training, consulting, coaching, resources, and experiences related to transformational retreats, retreat businesses, entrepreneurship, marketing, and related subjects.

Our programs, including Sacred Retreat Success™ (“SRS”), are educational and business-development programs.

Unless expressly stated otherwise in a separate written agreement, participation does not constitute professional licensure, accreditation, or professional certification.

PROGRAM ENROLLMENT

Certain Divine Destinations programs and services require a separate enrollment agreement, service agreement, waiver, or other contract.

If you enroll in Sacred Retreat Success™ or another paid program requiring a separate agreement, that agreement governs matters specific to your participation, including payment obligations, program access, cancellation and refund provisions, guarantees, participation requirements, Immersion terms, and other program-specific conditions.

If these website Terms conflict with a separately executed enrollment agreement regarding a purchased program, the executed enrollment agreement controls with respect to that program.

SRS IMMERSIONS

Sacred Retreat Success™ may include or provide access to in-person Immersions or other experiences.

Attendance, availability, scheduling, travel requirements, accommodations, activities, and participation may be governed by additional policies, waivers, releases, or enrollment terms.

Unless expressly stated otherwise in writing, participants are responsible for their own transportation, airfare, travel arrangements, travel insurance, and other personal travel expenses.

NO GENERAL GUARANTEE OF RESULTS

Starting, operating, marketing, or hosting a retreat involves business and financial risk.

Individual outcomes depend on numerous factors, including a participant's existing business, audience, experience, pricing, implementation, marketing, sales, participation, expenses, venue costs, market conditions, and circumstances outside Divine Destinations' control.

Except for a specific written guarantee expressly included in an applicable enrollment agreement, Divine Destinations does not guarantee that participation will result in any particular level of revenue, profit, enrollment, business growth, or other financial outcome.

SRS PROGRAM GUARANTEE

Sacred Retreat Success™ may be offered with a specific written performance or profit guarantee.

Any such guarantee is governed exclusively by the terms contained in the applicable SRS Enrollment Agreement and/or written guarantee terms.

Eligibility may require completion of specified actions, implementation requirements, participation requirements, deadlines, documentation, and other conditions.

Nothing contained on a general website, social media post, advertisement, testimonial, sales conversation, or marketing page modifies, expands, or replaces the written terms governing an SRS guarantee.

TESTIMONIALS AND CASE STUDIES

Divine Destinations may share testimonials, client stories, retreat outcomes, revenue figures, profit figures, enrollment results, or other examples from clients or participants.

These examples reflect the experiences and circumstances of the individuals described.

They should not be interpreted as a representation that every participant will achieve identical or comparable results.

Where required by applicable law, Divine Destinations will provide appropriate information or disclosures concerning advertised results.

PAYMENTS

Prices and available payment methods are displayed at checkout, communicated during enrollment, or contained in the applicable enrollment agreement.

For Sacred Retreat Success™, payment obligations and any applicable cancellation, refund, default, or guarantee provisions are governed by the participant's executed SRS Enrollment Agreement.

THIRD-PARTY FINANCING

Certain programs may permit clients to apply for financing through an independent third-party provider, such as Affirm.

Divine Destinations does not make financing or credit decisions.

Approval, eligibility, repayment terms, interest or financing charges, and other financing conditions are determined by the applicable financing provider.

Applying for financing does not guarantee approval.

INTELLECTUAL PROPERTY

Unless otherwise stated, the content available through Divine Destinations websites, programs, courses, Immersions, and resources is owned by or licensed to Divine Destinations INC and protected by applicable intellectual-property laws.

This includes, without limitation:

  • The Sacred Retreat Success™ Method

  • Program frameworks and methodologies

  • Training materials

  • Videos and recordings

  • Written materials

  • Worksheets

  • Templates

  • Graphics

  • Branding

  • Course materials

  • Proprietary processes and systems

ACCEPTABLE USE

You agree not to use our websites, programs, content, or systems to:

  • Violate applicable laws

  • Attempt unauthorized access to systems or accounts

  • Introduce malicious software

  • Interfere with website or system operation

  • Misrepresent your identity

  • Infringe intellectual-property or other legal rights

  • Copy, distribute, or commercially exploit protected content without authorization

THIRD-PARTY SERVICES AND LINKS

Our websites and services may integrate with or link to third-party payment processors, financing providers, CRM platforms, scheduling services, social networks, video platforms, or other external services.

Divine Destinations does not control these third parties and is not responsible for their availability, content, policies, decisions, security, or performance.

Your use of a third-party service may be governed by that provider's separate terms and privacy policies.

WEBSITE AVAILABILITY AND ACCURACY

We make reasonable efforts to provide accurate and useful information.

However, we do not warrant that all website information will always be complete, current, error-free, or continuously available.

We may update, modify, suspend, or remove website content or functionality when appropriate.

LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Divine Destinations INC and its owners, officers, employees, contractors, and representatives will not be liable for indirect, incidental, special, consequential, or punitive damages arising solely from use of or inability to use our websites or free content.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

Liability associated with participation in a paid Divine Destinations program may be governed separately by the applicable enrollment agreement.

INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless Divine Destinations INC and its officers, employees, contractors, and representatives from claims, losses, liabilities, damages, or reasonable expenses arising from your unlawful use of our websites, violation of these Terms, or infringement of another person's rights.

HAWAIʻI CONSUMER PROTECTION

Divine Destinations conducts business from the State of Hawaiʻi and intends to comply with applicable federal and Hawaiʻi consumer-protection requirements.

Nothing in these Terms is intended to waive, restrict, or eliminate a consumer right or remedy that cannot legally be waived.

If a provision of these Terms conflicts with a non-waivable requirement of applicable law, the applicable legal requirement will control.

GOVERNING LAW

Except where applicable law requires otherwise, these Terms are governed by and construed in accordance with the laws of the State of Hawaiʻi, without regard to conflict-of-law principles.

VENUE AND JURISDICTION

To the extent permitted by applicable law, legal proceedings arising from or relating to these Terms or the use of our websites shall be brought in an appropriate state or federal court located in the State of Hawaiʻi.

Nothing in this provision prevents a consumer from exercising a right to pursue a claim in another jurisdiction when such a right cannot lawfully be waived.

SEVERABILITY

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent legally permissible and the remaining provisions will continue in effect.

PRIVACY

Use of our websites is also subject to our Privacy Policy.

CHANGES TO THESE TERMS

We may update these Terms periodically.

Any updated version will be posted with a revised “Last Updated” date and will apply as permitted by applicable law.
